Note 136992: NOTE-Shipper must certify on shipping orders and bills of lading at time of shipment that the actual value per pound of the property does not exceed 25 cents. If the shipper fails to so certify the actual value per pound, item 136950 will apply.
How to Determine Your Class
To find the correct freight class for your shipment:
- Confirm eligibility: shipment is used water or used gas not moving by pipeline, with actual value at or below $0.25 per pound (keep an invoice or manifest to document value).
- Select containment to prevent leaks: closed-head drums or IBC totes for water; DOT-rated cylinders with caps and valve protection for gas, secured in racks or cradles.
- Write a clear BOL line: “Water or Gas, used, NMFC 136990, Class 55, nonhazardous, actual value not exceeding $0.25/lb.” Include piece count and container type.
- If value rises above $0.25/lb or material is regulated, use the appropriate NMFC per Note (see item 136992) and apply HAZMAT rules when applicable.
