By accessing and using NMFC Codes ("the Service," "our website," or "the Site"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified terms.

3. Use License and Restrictions

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NMFC CODES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Direct Damages: Any shipping costs, reclassification fees, freight charges, or other direct financial losses resulting from use of our Service
• Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
• Business Losses: Loss of profits, revenue, data, or business opportunities
• Classification Errors: Damages resulting from incorrect, outdated, or incomplete NMFC code information
• Service Interruptions: Damages arising from Service downtime, errors, or unavailability

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

7. Intellectual Property Rights

NMFC Classifications: All NMFC codes and classifications are published by the National Motor Freight Traffic Association (NMFTA). We do not claim ownership of NMFC classification data.

Website Content: The design, layout, graphics, compilation, and presentation of content on this website are owned by NMFC Codes and are protected by copyright, trademark, and other intellectual property laws.

Trademarks: "NMFC Codes" and our logo are trademarks of NMFC Codes. "NMFC" and "National Motor Freight Classification" are trademarks of the National Motor Freight Traffic Association, Inc.

9. Data Updates and Accuracy

We update our NMFC database quarterly based on official NMFTA publications. However:

• NMFTA may publish changes at any time between our update cycles
• There may be a delay between NMFTA publication and our database update
• We cannot guarantee that all codes are current as of the date you access them
• Errors in transcription or data entry may occur despite our verification processes

Always verify NMFC codes with the current NMFTA publication or your carrier before making shipping decisions.

11. Termination

We reserve the right to:

• Terminate or suspend your access to the Service immediately, without prior notice, for any reason
• Discontinue the Service at any time without liability
• Modify or restrict features of the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to disclaimers, limitations of liability, and indemnification.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
